EPA Regulation Update

EPA Subpart W – Petroleum and Natural Gas Systems

All NOI’s must be submitted to the EPA to request the use of best available monitoring methods (BAMM) for 2012. The deadline for submission to EPA electronically through the e-GGRT system was January 3, 2012.

On December 23, 2011, EPA issued a final rule, amending specific provisions in subparts A and W. These revisions correct technical and editorial errors and address issues identified as a result of questions received from reporters. As expected, these amendments do not change the overall requirements, but improve clarity and consistency across the calculation, monitoring and data reporting requirements. This final rule addresses reporting requirements for the petroleum and natural gas industry under 40 CFR Part 98, the regulatory framework for the Greenhouse Gas (GHG) Reporting Program and requires petroleum and natural gas facilities that emit 25,000 metric tons or more of carbon dioxide (CO2) equivalent per year to report annual methane (CH4) and CO2 emissions from equipment leaks and venting, and emissions of CO2, CH4, and nitrous oxide (N2O) from gas flaring and from onshore petroleum and natural gas production stationary and portable combustion emissions and combustion emissions from stationary equipment involved in natural gas distribution.

EPA Mercury and Air Toxics Standards (MATS)

On December 21, 2011 the U.S. EPA announced standards to limit mercury, acid gases and other toxic pollution from power plants, including limits for HCL, SO2, PM and HAPs. The rules will affect approximately 1400 coal-fired and oil-fired power plants and cost $9.6 billion by 2016.
